Pentagon Investigates Senator After Video Urges Refusing “Illegal Orders”

The legislators urged military personnel to remember their oaths to uphold the Constitution and to disobey unlawful orders from the president.

The Defense Department has announced an investigation into Senator Mark Kelly of Arizona. The senator joined Senator Elissa Slotkin of Michigan and Representatives Jason Crow of Colorado, Chris Deluzio and Chrissy Houlahan of Pennsylvania, and Maggie Goodlander of New Hampshire in a video that encouraged members of the U.S. Armed Forces and the intelligence community to remember their oath to the Constitution and disobey “unlawful orders.” Five of the legislators served in the military, while Senator Slotkin formerly served in the Central Intelligence Agency.

The Pentagon stated that Senator Kelly, who is a former Navy captain, could potentially face disciplinary action under military law. The department cited “serious allegations of misconduct” in its announcement of the thorough review of the senator’s actions. The announcement cited statutes that allow for veterans to be recalled to active duty for court-martial and the penalties for those convicted of interfering with the loyalty, morale, or discipline of the military.

The department stated that all military members “have a legal obligation under the [Uniform Code of Military Justice] to obey lawful orders and that orders are presumed to be lawful. A servicemember’s personal philosophy does not justify or excuse the disobedience of an otherwise lawful order.”

President Donald Trump called the video “seditious behavior.”
